Reserved matters — unresolved
Reserved Questions and Delegated Implementation
Status: non-operative decision register. Prior-pass wording is preserved in the historical archive and does not compete with the current draft. For the broader project-status map, including settled design principles, RFC/expert-review questions, delegated implementation, and publication/process work, see Constitutional Review Matrix.
Resolved by approved continuation
Special amendment quorum removed; ninety-day same-text approvals and six-month restart settled; Court invalidation at two-thirds full membership; amendment referendum majority of valid votes with no turnout floor; ten-percent national constitutional petition and two-year objective-effect resubmission bar; protected organic-law each-caucus majority; war deadlines; substantive reduction safeguards; Sacred Sites Council voting; minor adoptive and equivalent descendant eligibility.
Latest resolved constitutional policy
Amendment referendum timing is 60–120 days after certification of the second approval, with cancellation/full restart after material change. Civil Service Charter petitions use five percent nationwide. The Transition Oversight Council has fifteen members, five per component, with routine and consequential thresholds. Constitutional readiness categories and a public, testable, time-bound Plan replace indicator reservations. Usual resident population and binding enumeration/privacy/religious-accommodation principles are settled.
Genuine constitutional reservations
[RESERVED — Inherited Property Claims. Public consultation draft:
../rfc/RFC-010-inherited-property-claims-succession-restitution.md.][RESERVED — Convention electoral rules and popular-ratification mechanics: require express settlement consistent with universal suffrage, non-domination, and Section 4's ban on voter-community classification. Public consultation draft:
../rfc/RFC-008-constitutional-replacement-convention-ratification.md.][RESERVED — Ratification Protocol: delegate selection, representative verification, Conference decision procedures, pre-ratification dispute-body composition, ratification electorate, thresholds, and timetables require express agreement before ratification. First appointments and enforceable interim justice arrangements must be settled to secure constitutional rights from the first day without giving the Council sovereign powers. Public consultation draft:
../rfc/RFC-009-founding-ratification-protocol-first-constitutional-authority.md.]
Inherited Property Claims retains succession law, conflicting prior legal systems, estates, trusts/representatives, multiple generations, divided title, proof, and impracticable restitution; “lawful heir” remains undefined. No inheritance model is adopted. The Ratification Protocol includes lawful founding authority, initial selecting entities and first constitutional appointments; convention elections and replacement-ratification mechanics remain reserved.
Professional Arabic/Hebrew translation, constitutional equivalence and right-to-left review remain required. Historical/linguistic commentary claims await review. The additional government succession contingency is now framed for public and specialist review in ../rfc/RFC-011-catastrophic-executive-succession-continuity.md.
Delegated details — pending implementing choices
- Protected Organic Government Law: negotiation and recurring-ballot schedules, organizational combinations, and later implementation of any constitutional continuity mechanism adopted after RFC-004 and RFC-011. It may not create an unapproved acting-minister or executive-succession pathway.
- Protected Organic Judicial Institutions Law: Commission size, selection/recusal and internal procedures, component fractions, shortlist and vote intervals, fixed finite acting-service maximum, independent removal-finding body procedures.
- Protected Organic Electoral Law: meaningful candidate-support quantities, endorsement eligibility and uniqueness, confidential authentication, audit/deletion, nomination-change timing; algorithm tie and unranked-candidate treatment; petition verification and referendum administration; technical reduction notice periods. Settled referendum timing and Civil Service petition thresholds govern these details.
- Protected Organic Return and Restitution Law: independent Commission appointments, composition and terms, staffing/forms/routine procedure, fair equivalent-family recognition. First appointments and inherited ownership remain reserved.
- Law and professional statistical standards: voluntary confidential aggregate reporting and disclosure methods, data separation, religious accommodation consistent with the settled Article 13 principles.
- Technical implementing authority under law: flag proportions/colors/dimensions/manufacturing; data-format versions, dates and interoperability; currency denominations and artwork under independent monetary authority. No technical values are invented.
- Sacred-site regulations: stable delegation administration, evidence and review procedures, physical arrangements and training consistent with Article 19; no manipulation of delegation structure.
Proposed materials are non-operative. Delegation supplies constitutional authority and constraints; it does not enact the unfinished implementing details. Prior registers are preserved in the package-level review-archive, not in the repository overlay.
- Protected Organic Population Enumeration Law and professional standards: exact enumeration method, administratively necessary residence edge cases, privacy/security protocols and independent expert/religious review remain delegated implementation questions. No single technique is declared halakhically sufficient for all interpretations.
- Transition Implementation Plan: objective, testable, time-bound technical measures and independent assessment procedures must be developed for all settled constitutional categories. Technical perfection is not required; founding authority remains reserved.
