Review matrix — non-operative status map
C1P Constitutional Review Matrix
Status: Non-operative project control document.
Purpose: Maintain one authoritative map of what is settled, what remains genuinely unresolved, what is delegated below the constitutional level, what requires specialist or public review, and what must wait until substantive stability.
This matrix does not amend the Constitution, enact an organic law, resolve a reserved question, or supersede the detailed register in constitution/reserved-questions/README.md. Where the detailed register and this matrix differ, the inconsistency must be reviewed rather than silently reconciled.
Classification
| Status | Meaning |
|---|---|
| CLOSED — integrated | The constitutional policy decision has been made and incorporated into the canonical draft. Reopen only for a demonstrated conflict, unintended consequence, or materially new evidence. |
| RESERVED — constitutional | A genuine constitutional decision remains unresolved and must be expressly settled before ratification. |
| RFC / specialist review | The constitutional objective is substantially known, but the correct mechanism is not mature enough to constitutionalize without focused outside review. |
| DELEGATED — protected organic law | The Constitution establishes the authority, purpose, safeguards, and required voting protection; implementation belongs in a protected organic law. |
| DELEGATED — law / regulation / plan | The constitutional rule is settled; technical or administrative implementation belongs below the constitutional level. |
| VALIDATION / simplification | No new policy should be presumed. The task is to test coherence, redundancy, complexity, interaction, and legal operability. |
| PUBLICATION / professional review | Work that should occur only after the substantive English constitutional structure is stable enough to justify publication, translation, or external certification. |
Current stage
The Constitutional Design Principles audit is complete enough to proceed. The audit did not reveal a fundamentally different Constitution hidden beneath the design document. It identified four places where existing constitutional logic needed to be made more explicit, and those changes have now been integrated into the canonical draft:
- citizenship and peoplehood;
- collective continuity;
- access to public information;
- general necessity, proportionality, and least harm.
Intergenerational stewardship remains primarily a design rule of constitutional humility: entrench enduring protections while leaving future generations lawful room to alter mechanisms that do not require permanent constitutionalization.
Master review matrix
| ID | Topic | Status | Constitutional layer | Current position | Remaining work / decision | Next gate |
|---|---|---|---|---|---|---|
| C-01 | Citizenship and peoplehood | CLOSED — integrated | Constitution, Arts. 1 and 20 | Citizenship is a civic/legal relationship. State recognition does not create, abolish, confer, revoke, redefine, or extinguish peoplehood. Equal citizenship cannot be conditioned on surrender or adoption of peoplehood. | Consistency review only. | New verification baseline. |
| C-02 | Collective continuity | CLOSED — integrated | Constitution, Art. 2 §2 | Enduring peoples and communities may preserve, develop, and transmit cultural, religious, linguistic, historical, and communal life without State-defined authenticity tests; collective protection cannot override fundamental individual rights or create civic hierarchy. | Consistency review only. | New verification baseline. |
| C-03 | Access to public information | CLOSED — integrated | Constitution, Art. 2 §20 | General right of access; withholding must protect legitimate interests, be necessary and proportionate, give reviewable reasons, disclose severable material, and remain subject to independent oversight. “Not public” does not mean “not reviewed.” | Develop implementing access-to-information procedures below the constitutional level. | Specialist administrative-law review. |
| C-04 | General necessity, proportionality, and least harm | CLOSED — integrated | Constitution, Art. 2 §21 and Art. 20 definitions | Proportionality constrains authority that otherwise lawfully exists; it does not create power. Absolute protections remain absolute; stricter specific provisions control. | Test interactions with emergency, military, surveillance, property, holy-site, and administrative provisions. | Whole-system interaction audit. |
| R-01 | Inherited property claims | RFC-010 DRAFTED — reserved constitutional question | Art. 3; public-facing source: rfc/RFC-010-inherited-property-claims-succession-restitution.md; Organic Return and Restitution Law cannot resolve the constitutional core by itself |
Return eligibility is separate from ownership and inheritance. “Lawful heir” remains undefined. Current occupants are not presumed culpable and restitution may not create new homelessness. | Governing succession law; nature of inherited right; equality limits on historical succession rules; estates, trusts, family representatives, missing heirs, multiple generations and divided title; wills/transfers; current occupants and purchasers; evidence; valuation; competing claims; communal property; limitation/finality; and when physical restitution yields to another effective remedy. | RFC-010 for property-law, succession-law, archival/history, displaced-family, current-occupant, housing, valuation, and religious/communal-property review. |
| R-02 | Constitutional replacement convention | RFC-008 DRAFTED — reserved constitutional question | Art. 12 §5; public-facing source: rfc/RFC-008-constitutional-replacement-convention-ratification.md |
Replacement requires a specially elected convention, three-fourths of each Assembly caucus, popular ratification of the same text, and preservation of enduring guarantees. Voter-community classification remains prohibited. | Convention initiation, size and electoral system; delegate eligibility and incompatibilities; internal voting; Assembly-convention relationship; ratification electorate and threshold; turnout; timing; rejection/resubmission; judicial challenge; implementation and continuity after adoption. | RFC-008 for comparative constitutional, electoral, public-process, multilingual, and transition review. |
| R-03 | Founding Ratification Protocol | RFC-009 DRAFTED — reserved constitutional question | Transition §1a; public-facing source: rfc/RFC-009-founding-ratification-protocol-first-constitutional-authority.md |
Founding authority must arise before constitutional institutions exist and from freely given Israeli, Palestinian, and minority participation without compulsory voter-community registration. Rights must be enforceable from the first day without granting sovereign power to a temporary unelected body. | Convening authority; delegate selection and verification; Conference composition and decision rules; pre-ratification dispute body; electorate and thresholds; language equivalence; failure/resubmission; first-day courts and remedies; first constitutional appointments; transitional administration and security; transfer and sunset rules. | RFC-009 for broad participatory, constitutional, electoral, transitional-justice, security, administrative, multilingual, and affected-community review. |
| X-01 | Classified/confidential accountability mechanism | RFC-001 DRAFTED / specialist review | Constitutional floor now exists in Art. 2 §20; detailed structure unresolved. Public-facing source: rfc/RFC-001-classified-democratic-civilian-oversight.md. |
Courts, Investigative Magistracy, and other constitutionally authorized independent oversight bodies must retain access where public disclosure is lawfully restricted. War powers also require public legal/factual justification while permitting protection of genuinely operational details. | Decide whether additional cleared civilian reviewers, inspectors, special advocates, vetted counsel, or another structure is needed; define appointment, clearance, independence, privilege, access, reporting, adversarial testing, emergency access, removal, and remedy. Avoid creating a mechanism that merely legitimizes secrecy. | RFC-001 is drafted for focused constitutional, national-security, civil-liberties, military-law, intelligence-oversight, and cleared-counsel review. |
| X-02 | Additional executive succession contingency | RFC-011 DRAFTED / specialist review | Art. 5 currently contains Deputy PM → Justice → Interior → Foreign Affairs → Speaker fallback; public-facing source: rfc/RFC-011-catastrophic-executive-succession-continuity.md |
Scenario review identified a concrete uncovered failure: simultaneous unavailability of the Prime Minister and every named successor would leave no person with clearly lawful interim head-of-government authority. The issue is therefore genuine continuity design, not fallback-for-completeness. | Determine the final catastrophic fallback, definition and proof of unavailability, immediate versus continuing authority, Assembly confirmation or replacement, reversion to higher-ranked successors, and interaction with RFC-002, RFC-003, and RFC-004. | RFC-011 for continuity-of-government, constitutional, executive-power, emergency-law, legislative-continuity, and security review. |
| O-01 | Organic Government Law | DELEGATED — protected organic law, subject to RFC-004, RFC-011, and RFC-015 | Art. 5 / Art. 20 | Constitutional thresholds and protected functions are settled. Acting-authority and protected-minister vacancy design remain open in rfc/RFC-004-protected-minister-vacancies-acting-authority.md; catastrophic executive succession remains open in rfc/RFC-011-catastrophic-executive-succession-continuity.md; the effect of early Assembly elections on the Prime Minister's fixed concurrent term remains open in rfc/RFC-015-early-assembly-elections-executive-term-synchronization.md. |
Negotiation schedules, recurring-ballot intervals, permissible ministry organization and combinations, and related administrative mechanics; later implement the dispositions of RFC-004, RFC-011, and RFC-015 without lowering confirmation, succession, or tenure safeguards. | Draft/review against Art. 5 without using temporary service, continuity procedure, or election-calendar rules to create an unapproved path around protected confirmation or fixed tenure. |
| O-02 | Organic Judicial Institutions Law | DELEGATED — protected organic law, subject to RFC-007, RFC-012, RFC-013, and RFC-014 | Art. 10 | Judicial adjudication and independent Magistracy fact-finding are constitutionally distinct. General Magistracy initiation remains open in rfc/RFC-007-investigative-magistracy-initiation-authority.md; Court Enforcement Corps status/control remains open in rfc/RFC-012-court-enforcement-corps-independence-powers.md; prosecution, Public Defense status/parity, criminal fact-finding, and the current JNOV mechanism remain open in rfc/RFC-013-prosecution-public-defense-inquisitorial-process.md; Constitutional Chamber cross-community jurisdiction remains open in rfc/RFC-014-constitutional-chamber-cross-community-jurisdiction.md. |
Commission size; component procedures; recusals; shortlist and vote intervals; finite acting-service maximum; independent removal-finding procedures; later implement the dispositions of RFC-007, RFC-012, RFC-013, and RFC-014 without silently selecting an initiation, enforcement-control, prosecution, criminal fact-finding, or Chamber-jurisdiction model. | Legal-institution design review constrained by the justice RFCs and Article 2 due-process guarantees. |
| O-03 | Organic Electoral Law | DELEGATED — protected organic law | Arts. 12–13 | Universal access to all three district contests, candidate-only caucus qualification, no voter identity registry, Ranked Pairs, amendment-referendum rules, and boundary safeguards are settled. | Candidate-support quantities; endorsement eligibility/uniqueness; confidential authentication; audit/deletion; nomination timing; Ranked Pairs tie/unranked-candidate rules; petition verification; referendum administration; technical reduction notices. | Electoral, privacy, security, and cryptographic/process review. |
| O-04 | Organic Return and Restitution Law | DELEGATED — protected organic law, subject to RFC-010 | Art. 3 | Commission role, separation of return from title, flexible proof, occupant protection, and remedy categories are settled. Inherited ownership, succession, and lawful-heir design remain open in rfc/RFC-010-inherited-property-claims-succession-restitution.md. |
Commission appointments/composition/terms; staffing; forms; routine procedure; equivalent-family recognition; later implement the RFC-010 disposition on succession, estates, divided claims, evidence, settlement, valuation, and remedy administration. It may not invent the reserved inheritance rule. | Draft only around, not through, RFC-010 until the constitutional core is settled. |
| O-05 | Organic Population Enumeration Law | DELEGATED — protected organic law | Art. 13 §6 | Usual-resident population, privacy separation, no religious/ancestral/caucus registration, indirect enumeration accommodation, and Yoma 22b concern are settled constitutional constraints. | Exact enumeration method; residence edge cases; temporary absence; privacy/security protocols; statistical standards; independent expert and religious review. | Statistical/privacy/security/religious-consultation review. |
| D-01 | Civil Service implementation | DELEGATED — law / charter | Art. 14 | Merit, impartiality, community representation, whistleblower protection, refusal of unconstitutional orders, and Charter amendment protections are settled. | Complete Charter procedures and administrative implementation consistent with constitutional protections. | Administrative/civil-service review. |
| D-02 | Transition Implementation Plan | DELEGATED — plan, subject to RFC-009 founding authority | Transition §§5–8 | Constitutional readiness categories are settled; perfection and invented speculative thresholds are rejected. V-01 transition review in reviews/V01-05-transition-handoff-first-institutions.md confirms that first EBC selection, interim adjudication/investigation, Stage One administration/security authority, Council vacancy succession, and temporary-to-permanent transfer cannot be invented by the Plan and remain subject to rfc/RFC-009-founding-ratification-protocol-first-constitutional-authority.md. |
After RFC-009 establishes lawful founding authority, specify objective, testable, time-bound readiness measures plus an office-by-office dependency, transfer, records, and sunset schedule for temporary-to-permanent institutions. | Technical multi-disciplinary review after RFC-009 disposition. |
| D-03 | Sacred-site operating rules | DELEGATED — regulation | Art. 19 | Rights, Authority structure, voting protections, civilian security limits, and emergency safeguards are constitutional. | Stable delegation administration; evidence/review procedures; site-specific physical arrangements; training and operational protocols. | Multifaith, conservation, safety, accessibility, and rights review. |
| D-04 | Technical standards | DELEGATED — law / regulation | Arts. 8, 15, 18 and related schedules | Technical values are intentionally not frozen constitutionally unless necessary. | Flag production standards; data/interoperability versions; civil timekeeping details; currency denominations/artwork and other technical standards. | Handle only when implementation requires them. |
| V-01 | Whole-system interaction audit | MAJOR INTERACTION PASS COMPLETE — open RFC dependencies remain | Entire constitutional order | Cluster 1 is documented in reviews/V01-01-executive-emergency-war-secrecy-oversight.md; Cluster 2 in reviews/V01-02-legislature-thresholds-deadlock-continuity.md; justice-system interaction in reviews/V01-03-justice-system-interaction.md. The LDC-01 quorum veto and LDC-02 dangling early-election authority were resolved through the validated short-form Article 4 Sections 3 and 10 integrated in commit 18d036a8182f8b2783ca886bc5826d1ae64cd2d1. Justice review identified additional genuine design questions now public-facing as RFC-012 through RFC-014. Elections/appointments/amendments interaction is documented in reviews/V01-04-elections-appointments-amendments-interaction.md; it identified executive-cycle synchronization and Mizan Authority appointment/tenure questions now public-facing as RFC-015 and RFC-016. Assembly vacancy design is public-facing rfc/RFC-002-assembly-vacancies-democratic-continuity.md; Speaker design and continuity is public-facing rfc/RFC-003-speaker-structure-removal-legislative-continuity.md; protected-minister vacancy and acting-authority design is public-facing rfc/RFC-004-protected-minister-vacancies-acting-authority.md; Interim Budget adaptation and prolonged fiscal-continuity design is public-facing rfc/RFC-005-interim-budget-adaptation-fiscal-continuity.md; legislative attendance, boycott, compensation, and accountability design is public-facing rfc/RFC-006-legislative-attendance-boycott-accountability.md; Investigative Magistracy initiation authority is public-facing rfc/RFC-007-investigative-magistracy-initiation-authority.md. |
Major interaction clusters are documented. Further V-01 work should be issue-driven by RFC/public/specialist feedback rather than another undirected full pass. | Current consultation baseline may proceed to V-03; final substantive freeze still requires RFC and professional-review disposition. |
| V-02 | Constitutional complexity / deconstitutionalization audit | CONSOLIDATED — current direct simplifications integrated | Entire constitutional order | First pass documented in reviews/V02-01-complexity-deconstitutionalization-continuity.md. Short-form Article 4 quorum/final-disposition and legislative-dysfunction rules were validated in reviews/V02-01A-short-form-article4-validation.md and integrated in commit 18d036a8182f8b2783ca886bc5826d1ae64cd2d1. Post-emergency systemic judicial review was validated in reviews/V02-01B-post-emergency-judicial-review-validation.md and integrated in commit 27a4cf77af054d9f3c967ea3b8cef74b9b5e6a71. Justice-system cleanup of magistrate term continuation and nonbinding investigative records was validated in reviews/V02-02-justice-system-simplification-validation.md and integrated in commit 739d39831dc7efe2fc51b56257c775cf6af26388. |
Whole-draft consolidation is documented in reviews/V02-04-whole-draft-consolidation.md; no further direct simplification is presently justified without either external review or an RFC disposition. |
Proceed to V-03 verification of the current consultation baseline; reopen V-02 only for a concrete complexity or delegation failure. |
| V-03 | Numbering, source architecture, and verifier baseline | COMPLETE — GitHub Actions verification 97/97; numbering architecture adopted | Canonical Markdown + publication pipeline | Readiness is documented in reviews/V03-00-baseline-verification-readiness.md. Canonical source blob is 7b6f46a0e51057dd8e803db62d4396a3c36daa44. Existing verification-results.json is historical and does not verify the current draft; website copies remain intentionally unsynchronized. |
Verifier expectations have been rebased and the historical 87/87 report archived. Live-source static checks passed before numbering cleanup, and the numbering/source architecture is now adopted in reviews/V03-01-numbering-source-architecture.md. GitHub Actions run #4 executed the rebased verifier successfully: 97 passed / 0 failed. Numbering architecture is adopted, explicit paragraph-coordinate validation is active, and the current consultation baseline is reproducibly verified. Final broad renumbering remains deferred until RFC consultation is substantively settled. |
V-03 complete for the current consultation baseline. Proceed to consultation/publication preparation without treating open RFCs as closed; P-04 website synchronization remains separately gated. |
| P-01 | Historical and linguistic commentary review | PUBLICATION / professional review | Non-operative commentary | Commentary is intentionally separate from operative constitutional rules. | Verify historical, linguistic, symbolic, and etymological claims; keep contested claims attributed and clearly non-operative. | Specialist review before final publication. |
| P-02 | Arabic and Hebrew constitutional translation | PUBLICATION / professional review | All legally authoritative text | Arabic, Hebrew, and English are intended to have equal legal authority. Machine assistance may aid drafting but cannot certify legal equivalence. | Professional legal translation; terminology tables; back-comparison; cross-reference verification; RTL review; reconciliation procedure for unintended divergence. | After substantive English freeze, before authoritative multilingual publication. |
| P-03 | External constitutional review | PUBLICATION / professional review | Entire project | Internal and model-assisted review cannot substitute for affected communities and relevant specialists. | Constitutional law; human rights/IHL; electoral systems; administrative law; economics; security/emergency law; transitional justice/property; accessibility; language; affected communities and civil society. Distinguish criticism of values from criticism of mechanisms. | Before ratification-oriented claims; preferably before final public consultation round. |
| P-04 | Website synchronization / public RFC release | COMPLETE — public RFC consultation live | Public site | V-03 now provides a reproducibly verified consultation baseline (GitHub Actions 97/97). RFC-001 through RFC-016 remain unresolved and must be presented as consultation material rather than adopted law. | RFC-aware generation and issue-specific feedback routing are implemented in repository source and documented in reviews/P04-01-rfc-publication-readiness.md. PHP lint and constitutional CI pass (97/97). Migration 009_rfc_submission_targets.sql is a hard pre-deployment dependency. RFC preview run #2 passed with all 16 targeted feedback links. Ephemeral MariaDB replay passes baseline + migrations 001–009. A full Playwright browser integration run now also passes guest, real magic-link account, signed-in-anonymous, receipt, withdrawal, dashboard-isolation, and privacy-event/database assertions. Selective DreamHost backend deployment completed. Live production testing exposed that migration 008 was absent while 007 and 009 were present; the corrected migration 008 was applied and the production schema now verifies 1 privacy-rights table, 6 submission privacy columns, 5 privacy-event columns, and 1 RFC-target table. The direct RFC-013 guest flow passes submission, receipt lookup, RFC labeling, publication-permission withdrawal, and private-state confirmation. Production database verification also passes for submission 33: guest-unlinked, private/no-attribution, RFC-013/general target, and correct append-only withdrawal audit event. The two live admin-view checks pass, and the live account-linked plus signed-in-anonymous RFC submission modes have also passed. Guest, account-linked, and signed-in-anonymous production submission/privacy behavior is now verified. Accessibility/link review now passes after correcting the Participate-page heading hierarchy and adding explicit keyboard focus to generated RFC pages (browser audit run 35485275242). Coordinated package rfc-public-release-package was uploaded to DreamHost. Live verification confirms the Review hub, RFC register, all sixteen RFC pages, representative RFC-001/008/013/016 targeted response links, sequence navigation, and Participate entry point. Predeployment automated browser audit passed responsive overflow, heading continuity, keyboard reachability, visible focus, and internal-link checks against the exact release source. P-04 is complete for the current consultation baseline; open RFCs remain unresolved consultation material. |
Preparation may proceed now; deployment/public synchronization remains separately controlled until staged outputs and feedback paths pass review. |
Settled matters not to reopen casually
The following are treated as settled constitutional policy unless the interaction/simplification audit reveals a concrete conflict or a materially new argument requires reconsideration:
- universal voter access to all three caucus contests and no voter-caucus registration;
- candidate caucuses as a non-domination mechanism rather than political-party or ideological classification;
- Ranked Pairs as the constitutional electoral method, with technical details delegated;
- ordinary, protected-executive, each-caucus, general-amendment, and specially protected amendment thresholds;
- amendment referendum majority of valid votes with no turnout floor and no communal vote tally;
- ten-percent national constitutional petition threshold and two-year objective-effect resubmission bar;
- amendment referendum timing of 60–120 days after certified second approval and full restart after material change;
- protected organic-law each-caucus majority;
- war notification, publication, authorization, expiration, reporting, renewal, and withdrawal rules;
- fifteen-member Transition Oversight Council with five members per component and distinct routine/consequential thresholds;
- usual-resident population as the apportionment basis with privacy, data-separation, and religious-accommodation safeguards;
- constitutional readiness categories with an objective public implementation plan rather than speculative readiness percentages;
- Sacred Sites Council voting structure and emergency safeguards;
- minor adoption and genuine equivalent parent-child relationships for return eligibility;
- distinction between return eligibility and inherited-property title;
- attribution of wrongdoing to responsible persons and institutions rather than entire communities;
- constitutional rights and responsibility following public power, including outside the territory where the State exercises relevant authority, custody, or control.
Review discipline
- A new concern should first be mapped to an existing principle, constitutional provision, reservation, or delegated implementation category.
- Do not constitutionalize a technical detail merely because it matters.
- Do not move a safeguard downward merely because it is complicated; first identify the constitutional failure it prevents.
- A reserved constitutional question remains visibly reserved until a reasoned decision is made. Implementing law may not silently decide it.
- Specialist review should identify tradeoffs and failure modes, not substitute outside authority for public constitutional judgment.
- Public feedback should distinguish objections to founding values from objections to the mechanisms chosen to implement them.
- Website publication, translation, and final numbering follow substantive review; they do not define substantive completion.
Immediate work queue
The currently identified focused RFC set is drafted through RFC-016. R-01 through R-03 remain reserved constitutional questions despite having public consultation drafts, and the other RFCs likewise remain unresolved consultation matters. The first V-02 simplification batch has now resolved the Article 4 quorum/dysfunction interaction and EWS-10 post-emergency review load without changing RFC-dependent policy choices. The major V-01 interaction clusters are documented and the current V-02 consolidation is complete. The consultation baseline is prepared for V-03 verification under reviews/V03-00-baseline-verification-readiness.md. Open RFCs remain unresolved; V-03 verifies the present source and does not close them. New RFCs should be added only if later review identifies a genuine unresolved constitutional design choice. Tooling/publication work begins only after this review batch reaches a stable checkpoint.
