Proposed organic law — not enacted

Proposed Organic Return and Restitution Law

Status: non-operative implementation proposal; not enacted. Original source: Article 3; newly approved continuation decisions. Disposition: implementation questions classified separately; prior wording retained in the external package-level review-archive/prior-pass. Intended legal type: protected organic law. Relocation approved: yes, for implementation details. Substance: pending implementing choices; constitutional safeguards control.

Enactment, amendment, and repeal require a majority of the authorized membership of each caucus under Article 20. Vacancies, absences, abstentions, and disqualifications do not lower the threshold. The law remains subordinate, cannot diminish guarantees, silently amend the Constitution, or evade higher thresholds, and is subject to Constitutional Court review when challenged. This proposal is not enacted by its constitutional designation.

Delegated questions: independent Commission composition, appointment procedure, terms, staffing, forms, evidence handling, and routine procedure; fair recognition of genuine enduring equivalent parent-child relationships begun in the descendant’s minority. Independent parental eligibility, equality with biological descent, no compulsory DNA, no presumption of fraud from non-biological status, and judicial review govern. Primarily status-seeking relationships and adult adoption alone do not independently qualify. No new evidentiary numerical test is selected. Ratification/first appointments and inherited property, succession, and lawful heirs remain constitutionally reserved. Public consultation on the inherited-property question is drafted in ../rfc/RFC-010-inherited-property-claims-succession-restitution.md; this organic-law proposal may not resolve that question independently.
