Controlling constitutional rules

Article 5 retains these governmental functions without permanently fixing the organizational chart. Protected confirmation follows the functions of Defense, Justice, Interior, and Finance despite renaming or combination; other ministers use the ordinary cross-caucus threshold. Succession references mean the confirmed minister responsible for the named function. No reorganization may give the executive control over independent judicial or monetary decisions.

Delegated implementation: negotiation schedules, recurring-ballot intervals, and organizational combinations remain to be drafted under the protected law without reducing confirmation safeguards. Any additional succession contingency remains a substantive policy question; none is adopted.

Enactment, amendment, and repeal require a majority of the authorized membership of each caucus under Article 20. Vacancies, absences, abstentions, and disqualifications do not lower the threshold. The law remains subordinate, cannot diminish guarantees, silently amend the Constitution, or evade higher thresholds, and is subject to Constitutional Court review when challenged. This proposal is not enacted by its constitutional designation.

Executive-cycle dependency

The effect of constitutionally required early Assembly elections on the Prime Minister's fixed concurrent term remains unresolved in ../rfc/RFC-015-early-assembly-elections-executive-term-synchronization.md. This organic-law proposal may regulate election-calendar administration only after that constitutional tenure rule is settled; it may not create automatic termination, reconfirmation, extension, or resynchronization of a Prime Minister's term by implication.

Stage One administration boundary

The first Article 5 Prime Minister is selected during Stage Two, while Stage One requires functioning civil administration and equal defensive protection. The source, scope, accountability, and sunset of temporary Stage One administrative and civilian security authority remain subject to ../rfc/RFC-009-founding-ratification-protocol-first-constitutional-authority.md and ../reviews/V01-05-transition-handoff-first-institutions.md.

This organic law may not treat the absence of a permanent Prime Minister as implied authority for the Transition Oversight Council, a predecessor executive, or any temporary administrator to exercise unrestricted Article 5 powers. Temporary authority must come from the lawful founding instrument and transfer automatically when permanent constitutional government becomes operational.
